Requisite Particulars and Process of Application for the Registration of Association
1. According to the law relating to Registration of Associations, Chairman or a responsible person of the local association shall apply voluntarily to the relevant registration board pursuant to the field of operational performance with the following documents:
- Stipulated form (Form 1, Form 4, Form (4A) ) (Attachment of the Copy of NRC Card).
- Recommendations of Relevant Union Ministries.
Terms and Conditions to be consistent with Local associations
2. The associations applying for the permission of the registration as Local association shall be consistent with the following terms and conditions pursuant to the article 4 of the rule.
- Rule of law, Security and existing laws of the State shall be complied.
- Development of Social Sectors of the State shall be focused.
- The rights of citizen shall be respected.
- Unity, religion and faith of the nation shall be respected.
- It shall be able to support the interest of the citizens and development of the country.
- In naming association, the name of the association shall be suitable for the coverage area in which the activities will be performed.
- Letter of request on recommendation shall initially be submitted by being attached to the relevant department and organization in collaboration and association with the processes and objectives of the association. The recommendation department and organization shall contemporaneously be submitted at the time of the issuance of temporary registration certificate.
Qualities to be compatible with the executives of the Local associations
3. In making application for the permission of the registration as domestic association, the executives of the association shall be consistent with the following qualifications subject to article 5 of the rule.
- Being citizen, associate citizen and the naturalised citizens;
- Being attained the age of 18 year;
- Not being religious orders;
- Not being prisoners;
- Not being unsound mind;
- Not being member of the association of providing assistance to unlawful association and their members under the existing laws or persons or association prescribed by the State on commission of terrorism.
4. Union Registration Board shall screen the application form submitted from the domestic association like so and on perfectness of the particulars and form 5 has to be issued on receiving application form to the applicant and it will be performed to be able to issue temporary certificate within 7 days. To be able to achieving registration certificate, it will be issued by convening meeting of Union Registration Board. For taking registration certificate, Kyat 1 lakh of registration fees of association shall be given to Myanmar Economic Bank (Nay Pyi Taw) and registration certificate shall be taken out by changing with temporary registration certificate.
According to Law relating to Registration of Association, application for the permission of the registration from the INGOs
5. According to the association registration law, INGO applying for the permission of the registration shall be entered into MOU with the relevant ministries for socio-economic development in Myanmar and recommendation of the relevant ministry, chairman or responsible person of the association shall apply together with the following documents to the Union Registration Board of Ministry of Home.
- Stipulated form ( Form 3, Form 4, Form (4A) ) (Passport / NRC Card Copy attached).
- Recommendation the Ministry of National Planning and Finance Development (Currently Ministry of Planning and Finance).
- Remark of Ministry of Foreign Affairs.
- Attachment of Copy or Original of MOU and attitude and Remark of the Relevant Ministry / Association to be collaborated ( to sign MOU).
- Under the article 11 of the rule of the law relating to Registration of Association, International Associations shall have coordination and Permission of Nay Pyi Taw Council or State or Regional Relevant Government to be performed operation.
Terms and Conditions to be consistent with INGOs
6. The association applying for the permission of registration as INGOs shall be consistent with the following terms and conditions subject to the rule clause(9)-
- Rule of law, Security and existing laws of the State shall be complied.
- Development of Social Sectors of the State shall be focused.
- The rights of citizen shall be regarded.
- Unity, religion and faith of the nation shall be respected.
- It shall be able to support the interests of the citizens and development of the country.
- The recommendations of the relevant union ministries and associations to be collaborated and associated with the processes, objectives and associations shall be attached and submitted.
The Qualifications of the Executives of INGOs
7. In making application for the permission of the registration as INGOs, the executives of the association shall be consistent with the following qualifications subject to clause 10 of the rule.
- Being citizen, associate citizen and the Naturalised citizens.
- Being attained the age of 18 year.
- Not being religious orders.
- Not being prisoners.
- Not being unsound mind.
- Not being member of the association of providing assistance to unlawful association and their members under the existing laws persons or association prescribed by the State on commission of terrorism.
8. Union Registration Board shall scrutinize the application form submitted by the international organizations like so and on perfectness of the particulars and form 5 has to be issued on receiving application form to the applicant and it will be performed to be able to issue temporary certificate within 7 days. To be able to achieving registration certificate, it will be issued by convening meeting of Union Registration Board.
